Encroachment Permit Fees

Deposit

The District requires a deposit for all encroachment permits.  The deposit covers the District’s legal, engineering, administrative, and consultant costs incurred in both drafting the encroachment agreement and carrying out the District’s duties thereunder.  The amount of this deposit varies depending upon the purpose, scope, and duration of an encroachment agreement. 

Generally, the District requires a deposit of $1,000 for right-of-way access encroachment agreements (Minor Permit) and $5,000 for construction activities encroachment agreements (Major Permit).

 The permittee will be informed of the required deposit amount during the preparation of the encroachment agreement and the amount will be set forth in the agreement itself.  Once a project covered by an encroachment agreement is completed, the District will either refund the permitee’s unused funds, or invoice the permitee for any outstanding, but unpaid District costs.

Fee Schedule

The fee schedule below provides the hourly rates for District Counsel, District Engineer, District Inspector, and District Staff to administer the Encroachment Agreement process:  

  • District Counsel: $350.00/hour
  • Associate District Counsel: $250.00/hour
  • District Engineer: $150.00/hour
  • Inspector: $105.00/hour
  • District Staff: $20.00/hour
